1. General points
1.1. Https://juwelis.digital/ is an offer from JUWELIS Asset Management GmbH, Firststr. 6, 8835 Feusisberg, Switzerland (hereinafter “JUWELIS”).
1.2. In the online shop https://juwelis.digital/shop/ JUWELIS offers different kind of products.
1.3. These general terms and conditions (hereinafter referred to as T&C) regulate the contractual relationship between JUWELIS and its customers.
2. Offer and Execution of Contract
2.1. The offer in the online shop https://juwelis.digital/shop/ is targeted to customers who have the power to act. From the offer excluded are customers in the USA and in countries that are affected by an EU embargo. In any case, the offers are not to be understood as binding offers, but merely represent the possibility for potential customers to submit their own offers.
2.2. After placing an order, the customer receives a non-binding order confirmation. JUWELIS reserves the right to reject the customer’s offer at its sole discretion. A contract is only concluded after confirmation of the dispatch of the ordered goods.
3. Order and delivery
3.1. Orders are entered via the website https://juwelis.digital/. If it is determined after the order confirmation that an item is not available, the corresponding order will be canceled.
3.2. The delivery period stated in the offer or in the order confirmation is only a guideline and is not binding. If a delivery period cannot be met by JUWELIS, the customer can withdraw from the order 30 days after the order confirmation.
3.3. The goods are always shipped. There is no entitlement to pick up the goods.
3.4. Shipment is executed and shipped to the addresses given during the order process at the customer’s cost and risk. The customer has the option to choose the transport warranty option when ordering. The transport warranty is completed by JUWELIS and ensures that the value of the goods ordered is compensated for in the event of transport damage.
3.5. The customer undertakes to check the delivered goods immediately for correctness, completeness and integrity. Damage to the delivered goods must be reported to the executing transport company and JUWELIS as soon as possible, but no later than 3 calendar days after delivery. In the event of complaints, all parts of the original packaging must be kept. These may only be disposed of with the written consent of the transport company or JUWELIS.
4.1. The price that is published at the time of the order applies. Any price changes that occurred after the order are not taken into account.
4.2. All prices published in the online shop https://juwelis.digital/shop/ include VAT (VAT) and early recycling fee (VRG) in Swiss Francs. Supplementary costs (e.g. shipping costs, packaging costs, surcharges for certain means of payment, transport guarantee, services) are not included in the price and are shown separately and can also be offset. Subject to technical changes, errors and misprints.
5. Payment and Retention of Product
5.1. The payment type specified in the online shop apply. There is the right to impose surcharges on individual payment type.
5.2. When purchasing with debit and credit cards, the debit is made at the time of the order. The data of payments via credit and debit cards are encrypted. When purchasing in advance, the order is only triggered as soon as the corresponding payment has been received by JUWELIS. The requested items cannot be reserved during this time. If payment has not been received by JUWELIS within 10 days, JUWELIS is entitled to cancel the order.
5.4. The goods delivered by JUWELIS remain in any case the property of JUWELIS until the entire purchase amount (including all surcharges) has been received by JUWELIS. JUWELIS reserves the right to have the property registered in the respective retention register or another register provided for the retention of product.
6. Return, Warranty and Repair
6.1. Right of return and exchange
The customer has no general right of return and exchange. A return or an exchange are in the exclusive decision of JUWELIS.
In the event of a warranty claim, the customer is entitled to rectification, replacement or change due to defects. JUWELIS has the choice of how to remedy the defect. If JUWELIS decides to change the contract, the reimbursement to the customer will be adjusted to the current value of the defective device. There is no entitlement to a free replacement device for the duration of the rectification of the defect. The following are excluded from the guarantee:
- Natural hazards;
- Moisture damage;
- Impact or fall damage;
- natural wear and tear;
- Software problems;
- Damage from external influences;
- Interventions in or modifications to the product;
- Wear parts such as batteries, rechargeable batteries, projection lamps and housing parts;
The statutory warranty rights and deadlines are excluded within the scope of what is legally permissible.
6.3. Limitation Period
The limitation period for the declaration of warranty rights is 2 years and begins at the time of delivery for each product. If a rectification or replacement takes place, the warranty obligation is not extended.
6.4. How to Deal with Defects
If there is a defect that does not fall under the grounds for exclusion of warranty, the customer will contact JUWELIS. The right to reimbursement of costs from external repairs is excluded. The customer must send the defective product to JUWELIS at his/her own expense and risk. The products must be sent with all accessories in the original packaging. If the original packaging is missing, the product must be packed for transport acordingly. If it is determined that a product sent in is not covered by the warranty (reasons for exclusion or outside the warranty period), the customer will be informed accordingly (email to the email address provided during the ordering process is sufficient). If the customer does not respond to the notification within 10 days and requests that it be returned at his own expense, JUWELIS has the right to dispose of the product without liability to pay compensation.
Claims for damages arising from the impossibility of performance, from breach of contract, from fault at the conclusion of the contract and from unlawful acts are excluded, unless there is willful or grossly negligent action. Liability for indirect damage and consequential damage resulting from use, incorrect performance or loss of performance is excluded.

9. Place of Jurisdiction, applicable Law
Only Swiss law is applicable with the express exclusion of the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is at the seat of JUWELIS Asset Management GmbH or at the customer’s place of residence.
